Practice Overview

Banking & Finance Law — Our firm assists depositors, lenders, and borrowers to comply with State and Federal banking statutes and regulations. Bankruptcy — Our firm represents banks, lessors, lenders, secured and unsecured creditors, individuals and businesses in Bankruptcy Court, as well as State and Federal Courts, to protect our client's interests and to maximize recovery of assets by our clients in bankruptcy proceedings initiated by individuals or businesses.

Business and Commercial Law — We provide a wide variety of services to our business clients ranging from advice in selecting the type of organizational entity under which to operate, preparation of agreements, and employee relations, to dissolution, and other matters.

Mergers and Acquisitions — We advise and represent clients in the sale and purchase of businesses, financing and funding for business operations, and related legal matters.

Estate Planning and Probate Administration — Our firm practices extensively in the area of estate planning and probate administration. We work closely with clients to understand their financial situation and their desires for their family, business and other potential beneficiaries. Then we craft estate plans designed to distribute the client's assets efficiently and in accordance with the law, while minimizing taxation.  We have experience with all the varied tools available for successful estate plans, including wills, trusts, healthcare powers of attorney, living wills, family partnerships, life insurance planning, charitable giving, and others.  We also advise clients in probate administration matters.

Real Estate Transactions — Our firm performs real estate transactional work for a number of mortgage lenders, title companies, builders, developers, real estate brokers, and individuals. We assist with the purchase and sale of real estate, including negotiating and drafting purchase agreements, ensuring good title, and closings. Our experienced attorneys also assist clients with the legal aspects of financing, re-financing, and foreclosures, 1031 exchanges (including special tax increment financing and other principal approvals), land and building developments and subdivision and zoning matters.

Municipal Law — Our attorneys who practice in the Municipal Law area have expertise and knowledge in the areas of powers and liabilities of local government and municipal corporations, including matters such as Sanitary Improvement Districts (SIDs), land use and zoning issues and injuries to personal or property by municipal employees.

Taxation — Our firm represents individuals and commercial clients in matters with tax implications, identifying and addressing state and federal tax issues, and structuring transactions to minimize taxes and avoid tax problems. We take great pride in our expertise in the area of tax foreclosures.

Litigation — We represent business and individual clients in commercial litigation, contract disputes, real estate litigation, and general civil litigation.

Tax Foreclosure - Our firm represents investors and property owners in connection with tax sale certificates and real estate tax liens.  We have substantial experience in handling foreclosures of tax sale certificate liens and complying with the State statutes and procedures for obtaining treasurer's deeds.

Employment Law

Sanitary And Improvement Districts - The laws by which a Sanitary and Improvement District (SID) is established and governed are unique to Nebraska.  A SID constructs and maintains the public improvements located within a residential, commercial, or industrial, development, which is outside boundaries of a City including streets, sanitary sewers, water systems, sidewalks and utility services.  We handle SID matters through all the stages of the SID's existence - from the initial planning and formation stages through construction of the public improvements by the District to the time when a District may be annexed by a municipality.
